Terms of Service

1. Acceptance of Terms

These Terms form a binding contract between you and Web3 Attribution Platform. Your use of the Service constitutes acceptance of these Terms.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Not be located in a country subject to economic sanctions or embargoes
• Provide accurate and complete information during registration

3. Description of Service

Web3 Attribution Platform is a SaaS tool that enables you to:

• Create tracked marketing links using unique reference tokens
• Track user clicks and conversions across blockchain networks (Ethereum, Base, Solana, TON)
• Attribute on-chain transactions to specific marketing campaigns
• View campaign performance dashboards and conversion reports
• Integrate with your dApps or landing pages via API or redirect service

Beta/MVP Notice: The Service is currently in MVP stage. Features may change, and service availability is not guaranteed.

4. Account Registration and Security

You must:

• Create an account to use the Service
• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the confidentiality of your account credentials
• Not share your account credentials with third parties

You are solely responsible for all activities under your account. We may suspend or terminate your account for violations of these Terms without liability.

5. Attribution Tracking

How Attribution Works

• You create a tracking link with a unique reference token
• Users click your tracking link and are redirected to your destination URL
• We record a “touch” on our servers and store a temporary identifier
• When a user connects a blockchain wallet, we record their wallet address
• When that wallet performs a transaction on-chain, we attribute it to your campaign

Data Limitations

• Attribution relies on users connecting wallets on your landing pages; we cannot track users who do not connect
• We use “last non-direct click” attribution: credit goes to the most recent tracked marketing touch
• Blockchain transaction attribution is pseudonymous; we cannot link wallet addresses to real identities
• Our data is a best-effort approximation; we do not guarantee 100% accuracy
• On-chain data sources (Etherscan, BaseScan, Helius) may be delayed or incomplete

Your Responsibilities

You must:

• Not use the Service to track users without their knowledge or consent
• Not violate any user's privacy or any applicable data protection laws
• Ensure your privacy policy discloses that you track users via blockchain
• Comply with all applicable laws (GDPR, CCPA, etc.) when processing user data
• Not use the Service for any illegal purposes

6. Fees and Payment

Pricing

• Monthly subscription fees are listed on our pricing page
• Billing is in USD (or other currency as stated) and charged monthly in advance
• All fees exclude applicable taxes (VAT, sales tax, etc.), which you are responsible for

Payment Terms

• You must provide valid payment information to subscribe
• Payments are processed by Stripe; you agree to Stripe's terms and conditions
• Failed payments may result in suspension of Service access
• Refunds are subject to our refund policy (if any); we reserve the right to refuse refunds for access to the Service

Changes to Pricing

• We may change subscription fees with 30 days advance notice
• Your continued use after the change constitutes acceptance of new pricing

7. Your Content and Intellectual Property

You retain ownership of campaign data, tracking links, and reports you generate (“Your Content”).

By using the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to:

• Use, display, reproduce, and modify Your Content
• Store and process Your Content to provide the Service
• Use aggregated, anonymized data for analytics and service improvement

You agree:

• You own or have the right to use all Your Content
• Your Content does not violate anyone's intellectual property rights
• Your Content does not violate any laws or regulations

8. Prohibited Uses

You agree not to:

• Use the Service for illegal purposes or to violate any laws
• Spam, phish, or engage in fraudulent activities
• Attempt to access, hack, or reverse-engineer our systems
• Circumvent any security or authentication measures
• Violate anyone's intellectual property or privacy rights
• Use the Service for surveillance without consent
• Use the Service to process personal data in violation of GDPR, CCPA, or other privacy laws
• Create fake or misleading tracking campaigns
• Use the Service to track minors or vulnerable individuals without parental/guardian consent

10. Data Accuracy and Limitations

We provide attribution insights on a best-effort basis. You acknowledge:

• Attribution data is approximate and may contain errors or omissions
• We cannot guarantee 100% accuracy of blockchain transaction tracking
• Attribution may be incomplete if users do not connect wallets on your landing pages
• On-chain data sources may be delayed or unavailable
• We do not verify the identity of wallet addresses
• Attributing transactions to marketing campaigns requires assumptions that may not always be correct

13. Indemnification

You agree to indemnify, defend, and hold harmless Web3 Attribution Platform and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of any rights of others
• Your use of attribution data
• Your compliance (or lack thereof) with GDPR, CCPA, or other privacy laws

14. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, without liability to you.

Upon termination:

• Your right to use the Service immediately ceases
• We may delete Your Content within 30 days
• Blockchain transaction data recorded on-chain remains permanent

15. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Informal Resolution

Before filing any formal legal claim, you agree to contact us at info@web3trackers.com to attempt to resolve the dispute informally. If the dispute is not resolved within 60 days of submission, you or we may bring a formal proceeding.

Jurisdiction and Venue

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, United States, and you consent to the personal jurisdiction of such courts.

16. Modifications to Terms

We may modify these Terms at any time. We will notify you via email or in-app notification for material changes. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, that provision will be severed, and the remaining provisions will continue in effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Web3 Attribution Platform regarding the Service.
